These Official Rules form the terms and conditions for entry in the drawing for an iPod® Touch. Your submission of an entry signifies that you meet the eligibility requirements and accept these Official Rules and the decisions of Smiths Medical MD, Inc. (“Smiths Medical”), the organizer of this drawing, concerning these Official Rules.

1. Eligibility
Open only to legal U.S. residents 18 years of age or over as of the date of entry. Employees or agents of Smiths Medical, its affiliates, its advertising and promotional agencies, and the employees, officer directors, and agents of any of the above organizations, and the members of the immediate family or those living in the same households (whether related or not) of such individuals are not eligible.

2. How to Enter
Complete the registration form available at www.smiths-medical.com/Power beginning at 8:00 a.m. Central Time on November 16, 2007 and ending at 12:00 a.m. Central Time on December 21, 2007. No purchase is necessary. One entry per person. Smiths Medical is not responsible and shall not be liable for late or unsuccessful entries or efforts to notify any winning entrant.

3. Selection of Prize Winner
One prize of an iPod® Touch, with an approximate retail value of $399.00, will be awarded to one entrant. The Prize drawing is random. This Prize cannot be substituted for its cash value or other products or services. Winner will be selected in a random drawing to be held Friday, January 5, 2008 from among all eligible entries received. The odds of winning depend upon the number of eligible entries received. The winner will be notified by telephone or email and the Prize will be sent via U.S. mail. Subject to all applicable federal, state, and local laws. All taxes on the Prize are the sole responsibility of the winner.

4. Delivery of the Prize
The winner should allow approximately 4 to 6 weeks after the closing date of the contest to receive the Prize.

5. Other Terms and Conditions
By accepting the prize, winner grants to Smiths Medical the right to use his or her name, likeness and biographical information for any lawful purpose, including on Smiths Medical websites, without further permission or compensation, except where prohibited by law. All decisions by Smiths Medical regarding the operation of this drawing are final. This drawing is void where prohibited by law.

Smiths Medical respects your right to privacy. All “personal information” collected by Smiths Medical that you voluntarily provide through this contest, such as name, address, telephone number, and/or e-mail address will be used by Smiths Medical to contact you and/or supply you with information regarding Smiths Medical’s products and services

Smiths Medical will not provide your personal information to unrelated third parties, without your prior express consent, except as permitted under this Agreement.

Smiths Medical does not intend to collect personal information from children under the age of 18 without permission of the child’s parent or legal guardian. Children under the age of 18 should not provide personal information for this contest. If your child has provided personal information to Smiths Medical and you would like it removed, please notify Smiths Medical, and Smiths Medical will use its reasonable efforts to delete the information.

Smiths Medical will cooperate with governmental authorities and comply with all court orders involving requests for personal information.

The personal information Smiths Medical collects for this contest is an asset of Smiths Medical’s business and in the event that Smiths Medical, or substantially all of its assets associated with the relevant product range, are acquired or become the subject of a merger, such information may be transferred.

Please contact Smiths Medical if you have any questions concerning Smiths Medical’s privacy policy or the way Smiths Medical uses your personal information or if you would like to review your personal information that Smiths Medical has collected to update or delete it from our system.
